Tripster Website Terms of Use

1. This page details the Terms and Conditions ("Terms") which govern your use of our Website and your use of the services we offer. Please read them carefully. By using our website, you are indicating your acceptance to be bound by these Terms as well as the terms and conditions of our Privacy Policy. The Terms may be altered from time to time by updating this page. We would advise you to visit this page frequently to review the current Terms.

2. In these Terms the following definitions shall apply:"Content" means all postings, messages, text, files, images or other material on the Website, including, without limitation, descriptions of Items and Item profiles; "Tripster", "us", "we" and "our" means Tripster Labs Ltd, a limited company registered in England & Wales (registered number 07642828) whose registered office is at UNIT 11 HOVE BUSINESS CENTRE, FONTHILL ROAD, HOVE, BN3 6HA, United Kingdom;"User" means anyone using the Website for any reason; and"Website" means our website www.TripsterSki.com and all the pages, content and sub-domains contained in it.
Use of the Website

3. The Website may only be used for lawful purposes.

4. Users are prohibited from:
a) accessing data not intended for use by them or logging into a server or account which they are not authorised to access,
b) using any device, software or routine to interfere or attempt to interfere with the proper working of the Website or any activity being conducted on the Website; and
c) allowing others to use their login details to access any non-public area of the Website, disclosing to or sharing their password with any third parties or using their password for any unauthorised purpose.

5. We may, at our sole discretion, delete, suspend or deactivate any User account or otherwise terminate or restrict any User's access to the Website immediately and without notice if we believe that such User has acted inconsistently with the letter or spirit of the Terms. Neither Tripster nor its officers or employees shall be liable to any person for any termination or restriction of a User's access to the Website.
Intellectual Property Rights

6. Unless indicated otherwise, Tripster owns all intellectual property rights relating to the Website, including the designs, text, database, graphics and layouts, and Users are not permitted to use or copy any part of them without our express permission in writing. Tripster has applied to register the name "Tripster" as a trademark.

7. Users are not permitted to download, reproduce, copy, resell or exploit for any commercial purposes, any material or content on the Website, or to use automated means to download data from the Website (including without limitation, spiders, robots, crawlers or data mining tools, except for standard internet search engines).

8. Users are not permitted to decompile or disassemble, reverse engineer or in any other way attempt to discover any source code contained in the Website.
Limitations on Service

9. We may in due course establish limits on the use of the Website and we reserve the right at any time to modify or discontinue the Website (or any part of it) with or without notice.

10. We reserve the right to suspend the operation of the Website from time to time for any reason, including, and without limitation, to enable us to perform system upgrades or maintenance or to address technical issues. We will endeavour to provide reasonable advance notice of such suspension wherever practicable.

11. We shall not be liable to any User or to any third party for any modification, suspension or discontinuance of the Website or the Service or any part of it, including but not limited to for loss of profit or consequential or incidental loss or damage.
Limitation of liability and disclaimer

12. The Website and the Service are provided purely on an "as is" or "as available" basis. Accordingly, use of the Website is entirely at the User's risk. Any and all warranties relating to the Website, including, and without limitation, any implied warranties as to the fitness for a particular purpose and non-infringement of proprietary rights are expressly disclaimed to the fullest extent permitted by law.

13. We take reasonable care to ensure that the Website and its electronic communications are free of viruses. However, We make no warranty that the Website is free of viruses, malware or other harmful components.

14. Each User shall indemnify and hold harmless Tripster, its officers, employees, agents and service providers from any claim or demand (including reasonable legal fees and court costs) made by any third party due to or arising out of the violation of such User of the Terms or of any rights of any person or organisation.

15. The Website contains links to some third party web sites. These links are provided as a service and should not be considered as an endorsement by Tripster of the contents on such third-party web sites. We are not responsible for the content of these third-party sites and do not make any representations regarding the content or accuracy of materials on such third party web sites. For the purpose of clarity, Users accessing linked third party web sites do so at their own risk.
General

16. You may not under any circumstances assign or transfer your rights and/or obligations under these Terms or any Agreement into which these Terms are incorporated.

17. No person other than Tripster shall have any rights to enforce any of these Terms or any Agreement into which these Terms are incorporated.

18. These Terms shall be governed by interpreted in accordance with English law.

Tripster Mobile App Terms of Service

By downloading and using Tripster's mobile app ("Tripster," "application", "we" or "us"), you accept and agree to be bound by these Terms of Service. Tripster may at any time modify these Terms of Service. You can review the most current version of it by clicking on the "Terms of Service" link located at the bottom of the Tripster website, www.TripsterSki.com. The most current version will supersede all previous versions. By continuing to use the Tripster application after changes are made and published to the www.triptu.com website, you agree to be bound by such changes.

Privacy

Any information that you submit or we collect when you are using the Tripster application is subject to the Tripster Privacy Policy, detailed below and available on our website www.TripsterSki.com.

Limitations on Use

You must be at least 18 years old to download and use the Tripster application, or, if you are not at least 18, you may download and/or use the Tripster application only in conjunction with, and under the supervision of, your parent or guardian. If you do not qualify, please do not use the Tripster application.

Intellectual Property

Tripster and/or its licensors are the sole owners of the Tripster application, which includes any software, domains, and content made available through it. The Tripster application is protected by UK and International copyright and other intellectual property laws. It is for your own personal and non-commercial use only, and Tripster grants you a limited license for that purpose. Without limitation, this means that you may not sell, export, license, modify, copy, reverse engineer, distribute or transmit the Tripster application without Tripster's prior express written permission. Any unauthorised use of the Tripster application will terminate the limited license granted by us. Tripster and its graphics, logos, icons and service names related to the Tripster application are registered and unregistered trademarks or trade dress of Tripster Labs Ltd. They may not be used without Tripster's prior express written permission. All other trademarks not owned by Tripster that appear in connection with the Tripster application are the property of their respective owners, who may or may not be affiliated with, connected to or sponsored by Tripster.

Electronic Communications

By downloading and/or using the Tripster application, you consent to receiving electronic communications and notices from Tripster. Tripster Labs Ltd (the publisher of Tripster) may also send you electronic communications and notices promoting their own similar services from time to time. You agree that any notice, agreement, disclosure or other communications that we send to you electronically will satisfy any legal communication requirements, including that such communications be in writing.

Your Conduct

By downloading and using the Tripster application, you agree not to upload, post, e-mail or otherwise send or transmit any material that contains viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment associated with the Tripster application. You also agree not to interfere with the servers or networks connected to the Tripster application or to violate any of the procedures, policies or regulations of networks connected to the Tripster application, the terms of which are incorporated herein. You also agree not to: (1) impersonate any other person while using the Tripster application; (2) conduct yourself in a vulgar, offensive, harassing or objectionable manner while using the Tripster application; (3) use the Tripster application for any unlawful purpose; or (4) resell or export the software associated with the Tripster application.

Tripster does not promote, recommend or condone use of the Tripster application during certain activities, such as automobile driving, where there is a significant risk of accident. You agree not to use the Tripster application during such activities.

Third Party Offers

The Tripster application may contain links to third party web sites or programs that are not controlled by or affiliated with Tripster. Tripster is not responsible for the content, offers or privacy policies of such sites and programs, including, without limitation, your redemption of such offers or a merchant's refusal to honour any offer. Your dealings with third party sites are solely between you and the applicable third party.

Charges for Using the Tripster application

Tripster currently allows you to access the Tripster application free of charge. However, when you use the Tripster application, you may be subject to charges imposed by your wireless or other applicable carrier. Payment of such charges is solely your responsibility. The Tripster application may not be accessible in some foreign countries, this will depend on the Tripster application being supported by the foreign network. You should check with the local carrier whether you will be required to pay additional charges for such access. The ability to download or access the Tripster application may be restricted or impaired when on a roaming network abroad.

Booking on the Tripster application

You may use the Tripster application to book and pay for ski or snowboard equipment hire provided by equipment hire shops working in partnership with Tripster. In order for a booking to take effect, you will be required to pay the full amount for each booking directly on Tripster via our third party payment processor. Once payment is accepted, both you and the partner shop will be notified by email of the booking details, and an electronic voucher will be generated within the My Stuff section of the Tripster application. In order for you to pick up your equipment, you will be required to show either a printout of the confirmation email or to show your electronic voucher to staff in the shop. Upon presentation of the email printout or voucher, staff in the partner shop will provide you with the equipment you have booked. You are required to make your equipment hire booking at least 24 hours prior to picking up the equipment in-store. Responsibility for fulfilling the order lies with the partner shop. Partner shops are listed on the Tripster application. Please see below for details of our refund and cancellation policy.

When picking up your equipment, you must present the partner shop with an official picture ID (for example, passport, national identification card, or official driver’s license) and expressly agree to the partner shop making copies of these documents. The equipment can be picked up in the particular partner shop starting at 4:00 p.m. of the day before the hire date. The equipment must be returned before the end of business on the last day of the hire period. You are responsible for finding out when the closing times are. In the event the equipment is needed for longer periods, the difference between the actual hire period and the reserved and/or paid hire period is due on-site at the partner shop and is subject to local hire terms and conditions. If the hired equipment or parts thereof are not returned on time, you will be subject to an additional charge. The hire equipment must be returned in suitable operating condition.

Refund and Cancellation Policy

You may cancel your equipment hire booking in writing by sending an email to contact (at) tripsterski.com, subject to the following conditions:

A cancellation fee of 10% of the reserved equipment will be charged if you cancel your booking up to 10 business days prior to the first day of your booking.

A cancellation fee of 20% of the reserved equipment will be charged if you cancel your booking within 3 to 9 business days prior to the first day of your booking.

A cancellation fee of 30% of the reserved equipment will be charged if you cancel your booking within 1 to 2 business days prior to the first day of your booking.

Tripster Ltd will provide no refund if you cancel your booking on the first day of your reservation. The same will apply if you prematurely terminate the contract (i.e. you return the hired equipment prior to the termination of the hire period). You may receive a pro-rata reimbursement for any days remaining for equipment hire if you can provide documentation and medical certification of illness or accident. Any other agreements reached between you and the partner shop are, and remain, independent of this contract.

Tripster Ltd aims to process any agreed refund within 5 (five) business days after the cancellation request is received. The exact time at which such refund would be received depends on external factors outside Tripster's control, including bank transfer processing times.

Des frais d'annulation s'élevant à 30% du montant du matériel réservé seront appliqués au remboursement si vous annulez votre réservation de 1 à 2 jours ouvrés avant le premier jour de votre location

Tripster Ltd ne s'engage à aucun remboursement si vous annulez votre réservation le premier jour de votre location. De même, aucun remboursement ne sera possible si vous annulez votre réservation avant le dernier jour de votre réservation. Si vous rendez votre matériel en cours de location (c'est à dire avant la dernière date prévue par votre réservation), il est possible que vous soyez remboursé au pro-rata pour les jours non-utilisés, uniquement si vous fournissez une preuve officielle ou certificat médical indiquant que vous êtes en incapacité de skier ou de faire du snowboard en cause de maladie ou blessure. Tout autre accord conclu entre vous-même et le magasin de location de matériel est, et restera, indépendant de ces conditions d'annulation.

Tripster Ltd tente au mieux de procéder à tout remboursement accordé dans un délai de 5 jours ouvrés après réception de la demande d'annulation. Le jour exacte ou tout remboursement serait reversé sur votre compte dépend de facteurs hors du contrôle de Tripster Ltd, tel que le temps de traitement de votre banque.

No Warranty & Liability Limit

Tripster provides the Tripster application "as is" and without any warranty or condition, whether express, implied or statutory. Tripster specifically disclaims any implied warranties of title, merchantability, fitness for a particular purpose and non-infringement. Tripster assumes no liability or responsibility for any errors or omissions in the Tripster application; any failures, delays or interruptions in the Tripster application; any losses or damages arising from the use of the Tripster application, including, without limitation, any damage to your mobile device; or any conduct by users of the Tripster application. We reserve the right to deliver the Tripster application in our sole and absolute discretion. In no event shall Tripster, its shareholders, directors, officers, employees or agents be liable (jointly or severally) to you for loss of use or any special, incidental, indirect or consequential damages arising out of or in connection with the Tripster application or these terms of service, on any theory of liability, and whether or not advised of the possibility of damage. If any applicable authority holds any portion of this section to be unenforceable, then liability will be limited to the fullest possible extent permitted by applicable law.

Use of Information Submitted

You agree that Tripster is free to use any comments, information or ideas contained in any communication you may send to Tripster without compensation, acknowledgement or payment to you for any purpose whatsoever, including, but not limited to, developing, manufacturing and marketing products and services and creating, modifying or improving the Tripster application or other products or services.

Indemnity

You agree to indemnify and hold Tripster and its related companies, and each of their respective shareholders, directors, officers, employees, agents and merchant partners harmless from and against any third-party claim or cause of action, including reasonable attorneys fees and court costs, arising, directly or indirectly, out of your use of the Tripster application or your violation of any law or the rights of any third party.

Disputes

You agree that these terms of service or any claim, dispute or controversy (whether in contract, tort or otherwise, whether preexisting, present or future, and including statutory, common law and equitable claims) between you and Tripster arising from or relating to these Terms of Service, their interpretation or breach, termination or validity, the relationships which result from these Terms of Service, the Tripster application, Tripster's advertising or any related transaction shall be governed by and construed in accordance with the laws of England.

General

If any provision of these Terms of Service is held to be invalid or unenforceable, such provision shall be struck, and the remaining provisions shall be enforced. Headings are for reference purposes only and in no way define, limit, construe or describe the extent or scope of such section. Our failure to enforce any provision of these Terms of Service shall not constitute a waiver of that or any other provision. These Terms of Service set forth the entire understanding and agreement between you and Tripster with respect to the subject matter hereof.

Tripster Privacy Policy

Tripster values your privacy and is dedicated to safeguarding and preserving your privacy when using our application, visiting our website or communicating electronically with us. This Privacy Policy, together with our Terms of Service, explains what happens to the types of personal and non-personal information we collect when you use the Tripster application and website (Tripster). By using Tripster you agree to the terms of this Privacy Policy. If you do not agree to these terms please do not continue using Tripster.

Tripster uses the personal information we collect to provide our service to you. We will not rent, sell or share your personal information with any other company for its own marketing purposes without your consent except where mentioned within this policy.

In order to deliver you the best possible service when using Tripster, we collect and process the following information:

Information you provide us

When you use Tripster for the first time, we ask you to register and provide us with personal information as follows: Your name and email address.

We may use the information you provide us along with your voucher usage details, to provide you with a better experience when using Tripster. We will always provide you the opportunity to opt out of receiving any communication via email (you may request this by sending us an email at contact@triptu.com).

We do not store credit card details nor do we share customer details with any 3rd parties. Instead, credit card details are collected and processed securely by our third party payment processing agent in compliance with PCI data security standards.

In the future, we may sell, buy, merge or partner with other companies or businesses. In such transactions, we may include your information among the transferred assets.

Usage and redemption information

As part of the standard operation of using Tripster, we may collect certain non-personal information from you. For example, when you redeem a voucher, your mobile phone automatically records and sends basic information about your voucher redemption and application browsing. This may include the dates and times and redemption information. We may combine this non-personal information with your personal information.

Mobile phone location

When you use Tripster, we may receive your location and will use this to give you offers which are near you. Depending on your handset or the network you subscribe to, Tripster may automatically receive this information.

Directly communicating with Tripster

When you send email or other communication to Tripster, we may retain the communication in order to serve you.

Information you provide on our Partners' websites

You may find links to third party websites on our website. These websites should have their own privacy policies which you should check. We do not accept any responsibility or liability for their policies whatsoever as we have no control over them.

Use of Information and Data

All personal data is stored securely in accordance with the Data Protection Act 1998. Unless we are legally required to do so, your data will not be disclosed to third parties.

Where applicable, we may disclose your personal information to any member of our group. This includes, where applicable, our affiliates, our subsidiaries, our holding company and / or other companies within our group.

Use of Cookies

We may on occasion gather information regarding your computer whilst you are on our website. This enables us to improve our services and to provide statistical information regarding the use of our website to our advertisers where appropriate. Such information will not identify you personally it is statistical data about our visitors and their use of our site. This statistical data does not identify any personal details whatsoever.

Similarly to the above, we may gather information about your general internet use by using a cookie file. Where used, these cookies are downloaded to your computer automatically. This cookie file is stored on the hard drive of your computer as cookies contain information that is transferred to your computers hard drive. They help us to improve our website and the service that we provide to you.
